Child Act

Child Act 1989

This is an Act of Parliament of the UK that received royal assent on 16 November 1989 and came into substantial force across all three jurisdictions of the UK on 14 October 1991. In 1995, for the purposes of devolution, the Act was replaced by parallel legislation in Scotland & Northern Ireland. In 2016, Part III of the Act was replaced in Wales.

Child Protection Act 2004

The Act amended the Children Act 1989, largely in consequence of the Victoria Climbié inquiry. The Act is now the basis for most official administration that is considered helpful to children, notably bringing all local government functions of children's welfare and education under the statutory authority of local Directors of Children's Services.

What's the difference?

  • Focus on Responsibility: The 2004 Act emphasizes that all individuals and organizations working with children have a responsibility for safeguarding and promoting their welfare, which is a shift from the 1989 Act. 
  • Supplementary Nature: The 2004 Act was introduced to supplement the 1989 Act, addressing gaps in the national child protection strategy rather than replacing it.
  • Amendment Status: The 2004 Act serves as an amendment to the 1989 Act, meaning the latter remains the primary legislation.
  • Scope of Protection: The 1989 Act primarily focuses on children at risk, while the 2004 Act aims to enhance child protection and services for all children.
